Medical Malpractice
Medical malpractice is a negligence claim against health care providers. Generally, it occurs when a healthcare provider fails to provide the appropriate medical care and/or treatment which is considered the accepted standard of care and/or treatment any reasonably prudent similar health care provider would have given to the patient under the circumstances and, the failure to do so, causes the patient injury or death.
Once a patient consults with a health care provider, a duty of care is usually established. Expert testimony is required to set forth the specific care and/or treatment that should have been, but wasn’t provided, in order to establish the health care provider’s breach of duty owed to the patient. The expert must also establish that the inadequate care and/or treatment, more likely than not, resulted in or caused the injuries complained of by the patient.
